Who pays first?

Any individual whose Medicare eligibility began on or after 3/1/96, will have primary coverage from his/her EGHP for the first 30 months of Medicare eligibility.

Individuals who are self-employed who have an individual plan (non-EGHP) do not have a COB period.

Individuals who are self-employed and have a plan under the company name (EGHP) do have a COB period.

Individuals that have an individual plan under the Health Care Exchange do not have a COB period.

Individuals who have a SHOP plan under the Health Care Exchange do have a COB period.

What about patients who have SSDI Medicare or 65+ Medicare before developing ESRD?

They are AUTOMATICALLY enrolled in ESRD Medicare, and subject to the 30 mo COB rules as above (per Amy's conversation with Valencia at Medicare on 3.18.14)
